Terms of Service

These Terms of Service (these "Terms") form a legal agreement between Drawin ("we", "us", or "our") and you ("Customer", "you", or "your") and govern your access to and use of the Drawin platform and services (the "Services"). By creating an account and using the Services, you expressly agree to these Terms and to be bound by all of the terms and conditions of this Agreement. If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to this Agreement. If you do not have this authority, or if you do not agree with this Agreement, you must not accept these Terms and you may not access or use the Services.

2.1 Access Grant

Subject to these Terms and your Subscription Plan, Drawin grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your personal or internal business purposes.

2.2 Subscription Plans

The Services are offered under different Subscription Plans with varying features and limitations. Plan details and pricing are available on our pricing page and are subject to change.

2.3 AI-Powered Features

The Services utilize artificial intelligence and machine learning to process your content and generate infographics. You acknowledge that AI-generated content may contain errors or inaccuracies and should be reviewed before use.

3. User Obligations

3.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access or security breach.

3.2 Acceptable Use

You agree not to:

• Use the Services for any illegal purpose or in violation of any laws
• Attempt to circumvent usage limits or restrictions on your Subscription Plan
• Reverse engineer, decompile, or disassemble any part of the Services
• Use the Services to create harmful, offensive, or inappropriate content
• Interfere with or disrupt the Services or servers
• Access the Services through automated means without our express permission (except via authorized API access)
• Resell or redistribute the Services without authorization

4. Intellectual Property

4.1 Drawin Property

The Services, including all software, algorithms, AI models, templates, and content (excluding User Content and generated Infographics), are owned by Drawin and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Services.

4.2 User Content

You retain ownership of your User Content. By submitting User Content to the Services, you grant Drawin a worldwide, non-exclusive, royalty-free license to use, process, and analyze your User Content solely to provide and improve the Services.

4.3 Generated Infographics

You own the Infographics generated by the Services based on your input, subject to your Subscription Plan. Drawin may use anonymized, aggregated data derived from usage to improve the Services and develop new features.

5. Payment and Billing

5.1 Fees

Paid Subscription Plans require payment of fees as specified on our pricing page. All fees are in U.S. Dollars and are non-refundable except as required by law.

5.2 Billing

Subscription fees are billed in advance (monthly or annually, as selected). You authorize us to charge your payment method on file. If payment fails, we may suspend or terminate your access to paid features.

5.3 Cancellation

You may cancel your paid Subscription Plan at any time. Cancellation will be effective at the end of your current billing period.

6. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Services, you consent to our data practices as described in the Privacy Policy.

7. Disclaimers and Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DRAWIN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES, AND YOU USE SUCH CONTENT AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAWIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Term and Termination

9.1 Term

These Terms begin when you create an account and continue until terminated by either party.

9.2 Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the Services ceases immediately.

10. General

10.1 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

10.2 Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Your continued use of the Services after changes constitutes acceptance of the modified Terms.

10.3 Entire Agreement

These Terms constitute the entire agreement between you and Drawin regarding the Services and supersede all prior agreements.
